b. The Secondary Warranty does not apply to: the defective workmanship of the ASTM Product itself (or of an ASTM Product in ASTM custody) offered for sale; the defective workmanship of any ASTM product not manufactured by Nasco; any indirect, incidental, consequential, or special damages (other than for lost data storage) arising out of, or in connection with, the use of, or the inability to use, the ASTM Product; and any documents downloaded from the ASTM Web Site during any license period.
a. The Primary Warranty is limited to the protection of the ASTM trademarks which appear on the ASTM Product. The warranty is in lieu of, and does not provide for, any other warranties. ASTM makes no warranty whatsoever except for damage caused by willful or negligent failure to follow ASTM's Steps to Quality.
c. In no event shall Nasco, or its officers, directors, agents, affiliates or representatives be liable for loss of data or income, or for damages of any kind, whether direct, incidental, consequential, indirect, special or punitive, regardless of legal theory of recovery, whether in contract, in torts (including, but not limited to, negligence, product liability and fraud), in equity or otherwise, even if Nasco has been advised of the possibility of such damages, regardless of the size of any settlement, verdict, or any other recovery.
d. The foregoing warranties apply only to the part or parts of ASTM Products covered by this Document; and the foregoing warranties do not apply to any specifications or terms of related ASTM Products.
Definitions in the above standard may differ from the definitions in the current ANSI/ASME Standard. All conforming product manufacturers, users and users' representatives must be aware of differences in the definitions used in the two documents and make appropriate changes in their systems and processes to properly account for the differences. d2c66b5586
